Question by Jeremy Richards: I am deaf and feel the insurance company discriminated against me and need legal advice proceeding ….?
Hi, my name is Jeremy Richards I am deaf by law.
Here is my story: Couple of years ago I purchased a brand new ATV from the dealership by means of financing it through my bank on a loan which I was required to have insurance on while paying for it. I went to Cotton States Insurance company and told them I had purchased the ATV new and wanted a full coverage policy on it as was required of me by the bank. I did not tell her to put the ATV policy on my renters insurance. I was currently at that time living in an Apartment called ” Park Place Apartments ” in Boaz, Alabama. I was not allowed to have my ATV there on the premises so I had to keep it at my dads house, Last week while I was in california on vacation someone stole my ATV outof dads barn. I went to the Insurance comapany to get a copy of my policy to report to the police and the insurance company said i had cancelled that policy just a couple of weeks ago because she said : ” you told me that you could not afford it ” That is a stupid excuse considering I was required to have insurance on it because it was on a loan. I never said that, I don’t know where she came up with that. I went up there to tell her i had moved and needed my policy changed to my new address on my renters insurance which never should have had anything at all to do with my ATV insurance but because they set it up with my renters insurance she gave me the cancellation policy to my ATV ” unknowingly to me ” and had me sign it. I thought I was signing my new residence ” renters insurance ” policy. She was not clear to where I fully understood something as serious as that. So they say now that theres nothing I can do because I cancelled a policy I had paid every month ” on time ” for 2 years without fail just cause she claims I said I could not afford it and that’s a lie i never said that. All i asked to do was change the policy to cover my new residence not my old one and instead i got screwed into thinking I was signing the new residence renters policy, Common sense should have dictated cause she knew i needed that plicy as was required by the bank so she should have made sure i understood I was cancelling my insurance on it and she didn’t write down on paper so I could understand she just mumbled away and had me sign papers and that was that. Now I am stuck to pay for something I don’t have all because I was let to believe I was signing something else. Is there anything I can do? I mean it dosen’t seem fair at all to me I feel like i have been discriminated against and taken advantage of.

Did they accept your monthly payments for the ATV policy after it was supposedly cancelled? Then you’re still covered. This is called ratification. If I act like we have an agreement (in this case, an insurance policy) by taking your money, then we have an agreement.

File in small claims court.

Anything that is actually costly to replace, like jewelry. Some of my husband’s cameras are specified on our policy, but if you are unsure which to contain then make contact with the insurance coverage business for advice.

Our Insurance co. we feel is giving us the run around and it’s hard to trust just anyone anymore. We think we need to move the whole life insurance to something more profitable. We have been paying into it for over 20 years.

What type of Home Owners Insurance do we need for our San Francisco condo?

We own a 1 unit of a 2 unit condo in San Francisco. We have a separate policy that covers our personal property within the walls of our unit. We and the owners of the other unit form the Home Owners Association, and are trying to figure out if we need a separate policy to cover the exterior and the yard, or if we can each get separate policies to cover our share. Any advice?

The HOA should get the master policy for the exterior and common areas. Do this so that you’re each not personally liable if something goes wrong – the HOA will be liable. For example, if a part of the building falls down and kills someone, you don’t want that on your personal insurance – that will likeley be excess and you’ll be responsible for what the insurance doesn’t cover.
