Can an Insurance Company charge damages for water damage when the condo board paid a deductible on their claim?

I am the tenant of a condo and had accidental water damage to the unit, and floors below. My landlord claims they do not have insurance to cover the damage, but the condo board does and has paid out a $5000 deductible for the insurance for all the units to the insurance company, which I have reimbursed. Now I have been contacted by the insurance company about being charged for the remainder of the damages.

What is condo improvement insurance?

I just moved to a condo (as an owner). I have condo improvement insurance for up to $50,000. On the phone the guy was like oh yea, you can get new carpet, new windows etc. This seems too good to be true. What is this?
I was told that this covered special assessments and anything else including windows that were assessed. I am going to call the insurance company. If all this is to improve the place in case of a major fire or flood when in fact the condo company also covers it then I dont know if I need this. I dont have a huge issue with what they put in here if it burns down in a way. I giess if the insurance only costs a couple of bucks a month then maybe.

The insurance that covers your condominium building or strata also covers your unit in it’s original form. Any renovations and/or changes you make to your unit are your responsibility. So if your unit originally had carpet in the living room, hallway and all the bedrooms, and you decided to replace it all with custom hardwood, should there be a fire and the entire building burned down, the condo/strata associations policy would only be responsible to rebuild your unit with similar carpet that matched the original. The unit Improvement and Betterments (or similarlly named) portion of your unit owner’s policy would pay to have the hardwood floors, and all other changes you did to the unit, reinstalled. Windows form part of the building so unless you replaced the windows in your unit out of your own pocket, any damages to the windows would be covered under the condo association/strata policy.

Will Condo Board take care of Insurance?

I am subletting my condo and would like to find out if there is a possible fire. I do have a condo owner’s insurance, but it seems to cover only personal belongings. What happens if there is a fire and the condo is damaged? Will the condo board take care of the damages and rebuild?

When you own a condo usually the association has a policy that covers the building itself (outer walls, roof, framing, plumbing, electrical) and the owner is responsible for (and hopefully has their own policy covering) the rest (paint, cabinets, fixtures, etc.) Your condo’s bylaws will spell out what the association is responsible to insure, but state laws (which have often changed to move more of the responsibility from the association to the unitowner) and different insurers can make that broader or more narrow.

Your own individual condo unitowners policy should cover the parts of the building that you are responsible to insure (building coverage, or additions and alterations) and your contents (plus other coverages like Personal Liability). Most unitowner policies have very small limits for building coverage (usually under $10000), so you have to increase that coverage to reflect your own rebuilding costs. (Personally, I carry $50,000 because in my community I’d have to even rebuild my staircase!)

Because you’re going to be renting out your unit you need to:

1. First check if there are any restrictions in your bylaws about renting out the policy.
2. Check with the insurance company for the association to see what the deductible is. If the total amount of your loss is less than the association’s policy deductible it obviously won’t pay, even if it is a covered loss.
3. Check with the company that has your individual policy to see if they will endorse the policy to allow you to rent it out, and if they will cover the association’s policy’s deductible (subject to your own) if there is a fire, etc. (they usually will) .
4. Adjust your own policy to reflect your new needs. For example, if you’re moving out all of y our furniture you don’t need as much contents (personal property coverage).
5. Increase your liability coverage to at least $300,000. As the owner you can be sued over the actions/negligence of the tenant.

So, the bottom line is that generally the association will rebuild for a fire, but unless it is a major fire it’s likely going to fall onto your shoulders, so make sure you are properly covered. There are so many variables you need to do your homework first.

how much condo insurance should one get?

if i have a condo that i want to get insurance for, what is a good amount? the condo is 1215 sq ft w/ 2 bath & 2 bedroom.

Well, you need to sit down with an agent and figure that out. Most of the time, you’re responsible for MORE than just the contents – but you need to read your bylaws to see if you’re responsible for studs in, or paint in, etc. Plus, any customizing you do – like that new kitchen. Plus, what’s the deductible on your master policy? You don’t want to get stuck with THAT much, if only your unit has damage.

Lastly, keep in mind that little talked about coverage – "Loss Assessment", for when you are assessed a portion of total damages that aren’t covered under the master policy, but would be covered if it was just your unit.

Too many variables for an accurate answer from those of us on the ‘net.

Condo flooding whose insurance cover what?

I live in a condo complex. The sink in the bathroom overflowed and flooded my bathroom as well as the condo below. I talked to the water damage guy and he says my insurance covers my damages & the insurance of the guy below covers his. Is this true?
My repairs are minimal, so I did not report it to the insurance. Also I have the regular condo insurance not sure if it covers this kind of flooding. Please advise

Should the condo association Master insurance cover the repairment?

If the damage was caused by the condo association property failing. Should the Master policy of the HOA cover the cost of the repair of my interior damage? Is it part of the liability of the insurance?
The detail is that the recent hurricane Ike damaged the roof of our building, what cause the water to pour into my neighbours unit upstair and further down to the ceiling of my condo.

In my experience, they should. I live in South Florida. After the hurricanes of 2004 we had many of our roofs fail. Because of this, many owners experienced damage to their internal walls. Our master policy for the condo association covered paid the damages. I’m sorry, I don’t know if they are required to do so, but I’m pretty sure they contacted our Association attorney. My advice is move quick, you don’t want mold to become an issue. Also, the Association did not cover paint, so the owners were left with bare drywall. Best of luck, I know it’s tough recovering from a hurricane.

Will homeowners insurance cover taking down trees damaging the foundation of my house?

There are two large maple trees in my backyard. They were planted when the house was built in 1955. Recently we had some plumbing work done on our house in the basement crawlspace and the plumber told us that the roots of the trees are starting to come into the basement. If they continue they will damage the foundation of the house. Is removing the trees something that my homeowners insurance will cover because they are damaging the house?If so what do I need to do to get them to cover it?

Doubt it. homeowners insurance is to repair damage, not perform maintenance. If a tree fell on your house, they would pay to repair the damages.

Is it possible to find out a neighbor’s homeowners insurance company without asking them?

We have a neighbor with a hazardous, threatening tree that they refuse to deal with or let us deal with. We’ve been told that if we alert their insurance company they will probably force the homeowners to remove it. But how can I find that info out?

Due to the privacy act there is no way that I am aware of that you could possibly find this information. However in the meantime if you believe that this tree is a hazard and have tried to resolve this verbally it is now time to take it to the next level. As diplomatically as possible write a letter to your neighbor stating that it is your belief that the tree poses a danger to you and your property. In the letter you should offer to help pay a portion of the cost(s) for an inspection of the tree by an arborist and/or the cost of trimming or removal of the tree. Give a deadline for action on this matter. If the situation is not resolved by that date write a 2nd letter and again in a diplomatic fashion outline the same information but include a statement to the effect that if the matter is not taken care of and you subsequently suffer any damages you will have no option to but to sue them for their negligence–again give a date for compliance. Both of these letters should be sent via certified mail return receipt request and you should list on the bottom of the letter that you are sending a cc to your attorney and list his or her name. If both deadlines pass without any action, please consult your attorney. In a similar case that happened to one of my clients, the attorney wrote a letter and the matter was then resolved. However, if they do not respond to the attorney it is my understanding that they can be sued for having a public nuisance (I am not an attorney and this is my recollection of the terminalogy used in this area for this type of hazard). At the same time you are doing this you can also be calling your local housing compliance authority or if you are in a homeowners association call them and bring this matter to their attention so that they can also investigate and bring pressure to bear on your neighbor. Please make sure that you do everything possible to be diplomatic and do not take matters into your own hands–remember that this family will more than likely be your neighbors for a few years. Also make sure that they actually are the owners of the property, i.e. if it is a rental you will need to contact the actual owner not the occupant. You can find this information out on the internet by looking under the website for your local property tax authority–this information is public record and it will list the owners name, address, etc.
